1.1 COMPANY AND CLIENTS RESPONSIBILITY
It is Festival Travel & Tours responsibility to publish and inform the client(s) these and all of our terms and conditions.
It is the clients responsibility (and to inform all those in their party) to read these conditions reflect on them and if decide to continue to purchase a tour from Festival Travel & Tours, you all understand and are agreeing to all of the terms and conditions herein.
Travel Eagle Group, Inc. also known as Festival, Festival Travel & Tours, Toursfestival, Festival International Travel arranges with third party suppliers as independent contractors for the various components that compromises your tour package. We have taken all reasonable steps to ensure that proper arrangements have been made for your tour. However, Festival Travel is not an agent, or owner of these independent providers and we expressly disclaim any liability for their actions or omissions.
The Festival Travel name or logo may appear on posted or hand-held signs at the airport, ports, on buses, coaches, or other location during your tour and trip. This use of Festivals Name or logo is solely intended to help you identify persons or entities who might provide services to you during your trip, but does not indicate, and should not be understood by you or anyone else to indicate the Festival Travel owns, controls or operates any entity displaying such, a sign, or that Festival employs or controls any person holding or displaying such a sign.
By reserving and booking with Festival Travel you agree to the terms and conditions set forth herein. Any payment constitutes acceptance of the terms set forth herein, whether purchased directly from us or through a travel agency. The services described by us and the penalties that may arise in case of cancellations, interruption of travel. All policies, procedures and terms contained herein are subject to change at any time without notice at Festival Travel & Tours' sole discretion, please review these terms and conditions regularly. If you and your party book or purchase a trip through a travel agency, you your party and the travel agency remain responsible for knowing these conditions and informing you accordingly. Festival in turn will respond to your agency in case it communicates with us any questions about changes, cancellations, payments and refunds, travel documents and all points mentioned in this document
These Terms of Use govern your use of this site, which is provided by Festival Travel. By accessing this site, you indicate your recognition and acceptance of these Terms of Use. These terms and information published and used are subject to change without notice. Your use of this site following such changes constitutes your acknowledgement and acceptance of the changes. You should check these terms of regular use, and even days before making final payment and again before you travel.
You agree that Festival Travel is not responsible for any typographical errors, errors or itinerary changes, incorrect prices or price changes or offer withdrawals listed on the web site. If any provision of these Terms and Conditions or any part thereof is deemed unlawful, invalid or unenforceable, then that provision or part thereof shall be deemed separable and shall be construed as being separable and shall not affect the validity and enforceability of the remaining provisions, which shall remain in full force and effect. If Festival Travel does not act in connection with a breach by you or others of these terms and conditions, this does not waive Festival Travel's rights to act with respect to subsequent or similar violations
It is all the traveler's responsibility to read the travel proposal before purchasing our services and modify any errors in the itinerary, hotels, price, flights, dates, names, etc. It is also the traveler's responsibility to check that they have all the necessary travel documents before purchasing a trip. Once the purchase is made, it is subject to the conditions of purchase and cancellation and this may result in penalties of changes and or cancellations that would be the customer's full responsibility, having them to pay the penalties for all passengers on the services purchased.
The payment of a trip is equivalent to the acceptance and contracting of the services as described by us right before making your payment and also the penalties that these may raise in case of interruption of the trip.
Festival Travel acts solely as an independent sales agent for travel providers who provides you with travel and related services, including but not limited to hotels, cruise lines, tour operators, airlines, DMC/transportation service provider, bus operator, transportation operator, land manager, carrier, accommodation provider, local operator, travel provider, insurance or travel company and all other providers. You agree that Festival Travel, (Travel Eagle Group, Inc.) its shareholders, directors, employees are not responsible for any act, error, warranty, representation, non-compliance, negligence or omission of the Suppliers, their failure to provide The Services or adhere to their own schedule, their failure to pay for any refund or for any personal injury, death, property damage or other loss or expense, accident, delay or irregularity that may be caused by the Suppliers or any other control of connection occurrence that causes you to lose all or part of a trip.
The Suppliers providing the Services are independent entities and are not Festival Travel Agents, employees, contractors, servants, partners, or joint ventures of Festival Travel. All travel documents and travel arrangements issued by Festival Travel are subject to the terms and conditions specified by the Suppliers and to the laws of the countries in which the Services are supplied. In the event that the terms and conditions of particular Suppliers are incorrect, modified, or missing you agree to be subject and bound to the correct terms and conditions of the respective Suppliers. Festival Travel is not responsible for the decision of any insurer or insurance or administrator under the Travel Protection Plan (if travel insurance is purchased). You and your party hereby agree to release and hold harmless Festival Travel, (Travel Eagle Group, Inc.) its shareholders, directors or employees from all claims, damages, losses, or expenses arising out of or in connection with the Services. Festival Travel has no special knowledge of the Suppliers, the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov, and click on "Travel Warnings" and "Travel Alerts". For medical information, we recommend contacting your doctor and the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You assume full and complete responsibility for all risks of travel and for complying with all laws of the country in the Itinerary. Festival Travel does not suggest, recommend any specific tour, event, excursion or similar. You do these all at your own risk. You hereby release Festival Travel from all claims arising out of any problems covered in these terms.
Responsibilities of travel agencies outside Festival Travel and Tours.
If you purchase a Festival Travel & Tours trip through a retail travel agency, you are and your travel agent responsible for providing information to you and your group, examining and verifying all your travel information, providing us with the exact data to issue your documents, and ensuring that you understand all policies, rates and requirements to which you are subject. It is responsible that the travel agency also informs everything about travel requirements such as vaccinations, visas, passport to the travelers.
Any travel agency that makes a reservation on your behalf recognizes this responsibility. In this case, our client that we will be communicating with is your travel agency.
1.2 DISCLAIMER
In that you are traveling to a foreign country whose culture, customs, habits and lifestyle may be different than those of your residence country, we wish to advise you that we cannot guarantee the availability of non-smoking rooms, wheelchair/handicap access, quality of service or noise restrictions. Music from nightclubs, other guests of the hotel and/or animals in their natural habitat, may produce noise at earlier or later hours than might be expected by you in your country of residence, who may anticipate curfews and other regulations set by the hotels, the cities and countries visiting. You have reviewed the cities areas and hotels you will be staying at and are comfortable with these choices. Please understand that once on site, Festival Travel cannot compel the hotel, city country to change their customs and habits to suit your specific wishes; nor can Festival Travel, the hotel, tour company, city, or country be held financially responsible for any inconvenience or discomfort caused as a result of local cultural norms. We are not responsible for any delays that airlines, boats, trains may cause, nor are we responsible for portions of the tour that may be lost when they cancel their trips. In the event that this happens, Festival will try to accommodate the best solution according to the possibilities that we have on the spot. We highly recommend purchasing a Travel Insurance policy that can cover at least all your medical insurance needs and full investment for this tour.
1.3 Visas, Passports and Vaccinations
All travelers must confirm the consulates of the countries they are traveling to, including transits and carry their documentation in order (passport, visas, health certificates or other additional documents) necessary such as that they may need to travel to all the countries they will be visiting, being their full responsibility the inconveniences that may arise due to non-compliance with this rule. It is the passenger's responsibility to securely store their travel documentation with them.
Passports:
The traveler's passport must be valid for at least 6 additional months on the first day of the start of the trip for most countries. Festival is not responsible for the omission of this requirement and the implications that may arise from the lack of these.
Visas:
Your trip may require visas and/or vaccinations. The specifications or requirements of each country are the autonomy of each consulate and their country. These may vary before, during or after the trip. It is the total responsibility of the traveler to consult directly with the consulate/embassy and his/her doctor about these requirements. It is the responsibility of the agency that contracts our services to inform the traveler that they consult these requirements with the consulate.
Festival is not responsible for the lack of visas and/ or vaccines and the implications that may arise from the lack of these.
"Cancellation by force majeure" is not considered the interruption of the services contracted for not carrying the necessary documentation or as a result of the refusal of passage at any border for this reason. Any exchange or cancellation fees must be borne by the customer.
Vaccines:
Vaccines are required in some countries depending on the country from which the traveler comes or has visited in the last 2 years. This information may be consulted with the consulate of the country of destination and/or your doctor.
1.4 Read your documentation completely
It is the traveler's responsibility to read all documents sent to him, from the moment he receives the travel proposal to the receipt of the documents after having purchased them. Information such as flights, names, destinations, dates, itineraries, hotels and important notices. Transportation Security Administration (TSA) regulations require you to provide your full name as it appears on your passport or travel documents, date of birth and gender at the time of booking. If you do not provide this exact information, you may not be allowed to travel. For more information, visit www.tsa.gov
In our travel transaction there are at least 4 parts:
- the proposal or formal quotation of a trip which we send to the customer by email or other written means,
- the review and acceptance by the customer and consequently the purchase of the same
- the issuance and sending of documents related to your purchase by us
- and the reception and review of it by the traveler.
The travelers are responsible for that correspond to him (point 2 and 4) The customer must inform us of any necessary corrections to his quote and/or travel documents as soon as he/she has received it. In the event that the customer has not read his documents and advise of any changes that must be made, and more than 24 hours have passed from the date received, the customer will most likely incur changes or cancellation costs imposed by travel providers both cruise ships, ticket tickets and other services and these expenses will have to be borne by the traveler.
1.5 Beginning and end of our services
Our trips contain ground services and/or other services that are mentioned in the itinerary, for example: boat, train, or other travel.
Our services start from when the traveler arrives at the destination. In case travelers have booked airport/hotel transfers then the service includes from the time the traveler arrives at the airport. In the event that they have not contracted the transfer, the services start from the first day of tour according to itinerary.
If customers contracted the airport transfer, our services end with the corresponding transfer. If customers have not booked the transfers with us, the services end as mentioned in the itinerary. We are not responsible for any delay’s airlines may cause, nor are we responsible for portions of the tour they may lose when airlines cancel their trips. In the event that this happens, Festival will try to accommodate the best solution according to the possibilities we have on the spot.
It is important that you purchase travel insurance to be covered under these types of situations.
1.6 Transfers
When transfers are booked with your trip: The guide/driver will be waiting for you at the airport at destination. In the event that your flight has been delayed or cancelled, the traveler must report this incident before the flight leaves directly to the emergency phone number provided with their documentation. However, this does not guarantee receipt of the message considering that perhaps when the message is sent in America during the day, it is received at destination the next day due to the difference of hours. Both Festival and the local operator will try as much as possible to get this information to the necessary transfer contacts as well. The message must be sent to both, Festival and the local operator in order to try to reschedule the transfer. However, in the event that, due to the delay in the flight, this is not possible, the traveler must take a taxi to the hotel at its own cost and Festival will not be responsible for the cost it may cause.
Festival considers that, if the traveler does not arrive at the destination due to the delay of a flight, then it is the airline responsible for the loss of this transfer and any other loss that its delay may have caused. We highly recommend that you purchase travel insurance to cover this, your health and your investment.
1.7 Alterations
Festival reserves the right to modify the itinerary in the case of certain reasons to include of force majeure and to safeguard the safety and well-being of the traveler. Festival is not responsible when these modifications have been produced by reasons of political phenomena and/or for reasons caused by nature. In the event that this happens, Festival will try within its possibilities, seek the best solution always safeguarding the well-being of the traveler and offer options that they consider possible to solve any problem of force majeure.
If you have not paid for your tour in full, you will be responsible for any increase in the price of any and all components of the tour package that may occur. Festival Travel reserves the right to Re-invoice your reservation should an error be made in computing your tour price. You may incur additional expenses that are not included in the tour price, including but not limited to (unless otherwise noted) gratuities, meals and beverages; passport/visa fees; airline seat assignments and baggage fees, departure taxes, resort fees, optional excursions etc.
1.8 Languages
The services will be organized in the language in which you have previously been contracted. Please keep in mind on very limited occasions there could be more than one guide on the tour to provide multiple languages interpretation for other travelers as well.
1.9 Luggage
Many airlines charge fees for checked and carry-on bags. Fees vary and are set by each airline. Information on carrier baggage policies and fees, liability loses, misconnected and damage baggage or other personal property can be obtained directly on the carrier’s web page or contacting them directly.
For our guided tours, the baggage authorized on each trip on the coaches/buses is one standard 50-pound (23 kilos) suitcase with dimensions of 62 inches (WxHxL) per person plus the carry-on case of no more than 15 pounds (8 kilos). Festival is not responsible if the passenger carries more luggage and the passenger cannot be accommodated. In the case of purchasing a tailor-made trip and/or in private, we will need to request authorization from the destination operator in order to guarantee the trip with more than one suitcase.
In the event that the airline loses its bags or delayed them, it will be the passenger's responsibility to report the loss with the airline and follow up until it is recovered. It is important that you purchase Travel Insurance to help cover this issue and you and your investment.
1.10 Hotels
Each trip is different, there are itineraries in regular with "planned" hotels and there are tailor-made trips with guaranteed hotels.
The planned hotels are pre-contracted, the destination organizer may vary the hotels planned when reservations exceed the basic limited space but will be of the same category or higher that was purchased.
Tailor-made trips, if they have guaranteed hotels and could be modified in a case of extreme need or a force majeure event. This is not a common action on our tours so it should be noted that we would only do this in case we would need to protect the customer.
Important: it is the responsibility of the person who hires the tour, to review the planned and/or guaranteed hotels, to know their location at destination and to read the comments in general. Festival provides you with the best options based on travel and offers options in one or more hotel categories.
The travel agency and/or customer must be responsible for what they have chosen since once this trip is purchased, we will proceed to pay for services in the destination country and have to change these services, we will be subject to the corresponding penalties according to each itinerary. The customer will then have to pay for these requested changes after the purchase of the trip. At the time the traveler contracts our services, the traveler is accepting the conditions, itinerary and hotels corresponding even to the modification of the hotels planned. (This does not apply to tailor-made trips with guaranteed hotels). We cannot know each hotel, it is the traveler’s responsibility to review the information of the hotel, remember in many parts of the world the categories of the hotels may not be the same as here.
1.11 Travel Insurance
Travel insurance is not normally included in your tour package, some tours might contain a basic and minimum insurance, if yours includes it, it will be mentioned in the section "Your trip includes:” in your travel documents. If it's not mentioned, it's because it doesn't include it. Either way, Festival highly recommends buying additional travel insurance that covers all your investment, your health and any eventuality the traveler needs and be covered. There are many good travel insurance policies to choose from, it is very important that you review and compare several of them and choose the one that best suits your needs.
1.12 Changes
In the event that any modification is requested after a trip was purchased, it will be subject to change penalties. Festival will have to consult the penalties corresponding to the itinerary with the local suppliers and will inform the customer to make a decision. It is mandatory to request the changes by email with the due amount of time necessary to be able to make these changes. Please note that there are changes that are affected by penalties which will be reported to them in a timely matter.
1.13 Cancellations
Cancellations must be received in writing via email and you must have received a confirmation email that we have received your cancellation request. All tour reservations may be canceled with a minimum fee up to 35 days before the travel date (except for exceptions previously mentioned in your reservation). A cancellation does not imply an automatic refund or credit. See refund and / or credit policies for more information.
Note: These expenses apply only to individual bookings (group bookings have their own regulation that is sent with your quote). These expenses apply to the ground tour part only and do not apply when there are other services such as flights, cruises, event tickets, train and other similar services which may have other regulations. Exception: In the event that your trip particularly has some other type of regulation regarding cancellation costs, either because they are special dates or services, the most restricted condition for penalties and fees will apply.
In the event there are penalties and fees for these types of cancelations they will be added to the below fees and penalties mentioned below either for credits or refunds.
Cancellations 60 days in advance or more from departure date:
- You can get a full credit for the total value of your deposit(s) (minus $35.00 per person administration fee) for an upcoming trip.
- You may request a refund for your deposit (s) minus $200.00 per person for administration fee in addition to any additional bank fees your deposits may have originated.
- It is very important that you purchase a travel insurance policy with in the first 7 days of leaving a deposit to cover your investment and health for your tour.
Cancellations between 59 days up to 35 days before the date of travel:
- You can get a full credit for the total value of your deposit(s) (minus $75.00 per person administration fee) for an upcoming trip.
- You may request a refund for your deposit (s) minus 15% of the value of the tour per person and no less than $200.00 per person for administration fee, whichever is highest, in addition to any additional bank fees your deposits may have originated.
- It is very important that you purchase a travel insurance policy with in the first 7 days of leaving a deposit to cover your investment and health for your tour.
Cancellations within 34 days before the date of travel:
- You may request a credit and Festival will charge 15% or $200.00 per person which ever is higher in addition to any bank fees and penalties of our suppliers at destination according to the table below:
(The 15% per person, no less than $200.00 per person of service charges will be used to partially cover the costs associated with professional advice and operating costs, additionally you will have cancellation fees from our suppliers according to the table below and as long as you have sent us an email from the trip within the days and hours of work and that we have answered a receipt email from you).
Here is the table of additional cancellations:
- 10% of the total value of the trip if the withdrawal occurs between 30-35 days before the date of the start of the trip.
- 20% of the total value of the trip if the withdrawal occurs between 25-29 days before the date of the start of the trip.
- 30% of the total value of the trip if the withdrawal occurs between 19-24 days before the date of the start of the trip.
- 100% of the value of the trip and withdrawal occurs within 18 days before the start date of the trip or if you do not cancel it.
1.14 International Air Flights /Other Services
Due to new TSA (visit www.tsa.gov) regulations and other countries' travel restrictions, you must provide us with the exact name or names to the letter as they appear on your passport, as well as the date of birth. Some providers may request copies of the passport/document you use to travel. Packages with airline and cruise components are subject to additional price increases that may be imposed by the supplier and/or government after you have completed your purchase.
In the event of airspace closures in exceptional circumstances (such as volcanic or other weather eruptions, strikes and other political or force majeure reasons, etc.) Festival will provide the necessary assistance to the extent of its possibilities in order to protect the peace of mind and security of the client. The conditions of our brochure apply only to terrestrial services as indicated on this brochure and on this website. Any other services contracted by the passenger or travel agency in addition to our ground tour (e.g. international flights, other tours, event tickets etc.) It will not affect the conditions of the land travel and any eventuality that these entities cause must be handled independently.
In the event of airspace closures in exceptional circumstances (such as volcanic eruptions or other weather reasons, strikes and other political reasons, etc.) Festival will provide the necessary assistance to the extent of its possibilities in order to protect the tranquility and security of the client.
Air flights purchased with Tours Festival have normal Airline restrictions: They are non-refundable, and if a date change is requested, we will have to consult with the entity where the ticket was purchased, this can be direct with the airline or a wholesale flight broker that we may have used to get you a better rate that you have previously accepted. When making a change in flight or date, these are subject to fare changes, and the customer must pay the fare difference if applicable, and the new fare is not nor will be compared to other internet prices. You also will be subject to a fee for re-emission of a minimum of $35 per ticket. Air tickets are non-transferable.
If, by an exception, the flight wholesaler or airline allows us to refund a flight, it will be subject to cancellation fees equivalent to a minimum of 10pct of the price paid plus expenses from the bank for the use of your credit card. This ranges from an additional 3.5% to 5% of the amount charged on your card.
IT IS VERY IMPORTANT THAT YOU PURCHASE A TRAVEL INSURANCE POLICY TO PROTECT YOURSELF AND PROTECT YOUR INVESTMENT.
1.15 No Passenger Acceptance
It takes some physical and mental health capacity to be part of an organized group trip. In the event that the passenger has special physical or mental health limitations, the passenger must notify Festival Travel in writing at the time of making a reservation, thus allowing us to analyze each case and accept or not and advise the benefits and/or disadvantages of taking or not taking one of our tours. You should also notify us if there is a person traveling alone over the age of 80. Festival is not responsible for the consequences that may cause the lack of communication between the client and/or the agency that contracts the services or to inform us. In no case do the contracted staff or we physically lift or assist customers inside or outside the transport vehicles. Please note that in many countries they are not adapted with ramps or rooms adapted for the disabled and cannot be compatible with the standards required by the American Disability Act and are not in the control of Festival Travel. In the event of a person who has obesity conditions where that could mean the impossibility of occupying a single coaching place and without causing discomfort to other passengers, they may request an additional supplement in order to provide an adequate service for the comfort of the passenger.
The NO NOTICE of these special conditions of the passenger in writing at the time of booking and with at least 60 days before traveling, may be sufficient cause of refusal of the tour and losing your investment. We regret that we cannot provide special individual assistance to travelers with special needs for ordinary daily activities, such as walking, eating and other special needs. In such a case, our liability will be strictly limited to reimbursement of the recoverable cost of any unused portion of the tour provided by the provider, if any. If you choose not to participate in certain parts of the tour or use certain products included in the tour, no refunds will be made for the unused parts of the tour or the goods. You agree to indemnify and hold Festival Travel harmless from any costs, damages, losses or liabilities arising out of the actions or omissions of you or your companions.
Operators in each country also reserve the right of expulsion of passengers who significantly disrupt the proper development of the tour and or disruption to other passengers and any additional costs that may be incurred to the customer will be the responsibility of the passenger directly. Festival Travel will not be liable for any expenses that may result from this expulsion.
1.16 Tips
Tips are not included and are not mandatory. However, tips to guides is a common practice with all travelers. A tip of approx. $5 -$7.00 per person per day is considered reasonable.
Some tours of specific countries (e.g. Turkey, Egypt, Emirates) consider the tip an obligation, if this is the case, the customer will be given this information at the time of the travel quote, so the customer is free to choose this trip or ask us for another tour that has the tips already included.
1.17 Errors and Omissions
Every effort has been made to ensure the accuracy of information provided on this site. However, Festival Travel cannot accept any responsibility for errors or omissions.
To the extent permitted by law, Festival Travel is not liable for loss, damage or liability arising from errors, omissions, inaccuracies or any misleading or out of date information whether contained on this site or any link attached to this site.
By making your booking request, you acknowledge and agree that you have read, understood and agree to these Terms before making the final payment. These conditions may not be varied, altered or waived by any person, retail travel agent or representative of Festival Travel or any other person providing services on the tour. If you book on behalf of another party, you represent and warrant to Festival Travel that you are duly authorized to provide the agreement and consent to the other party and agree to indemnify Festival Travel for any breach of warranty in this regard.
Some hotels, tours have images on our sites and on our promotional materials and our web site that do not depict exact size of rooms, statues etc. Maps might not be to scale. Festival Travel is not responsible for omissions or errors.
Festival Travel reserves the right to cancel any paid booking or services for any reason it deems necessary due to false information or intention including errors and omissions of any party. You understand and agree that Festival Travel's sole responsibility for such an event will be a refund of all or part of the money paid on the purchase of the services through Festival Travel. You understand and hereby agree to submit any and all written claims to Festival Travel no later than 30 days after the original date of travel, you also understand that if you file any lawsuit against Festival Travel you will have to do so no later than one year after the end of the trip, and that failure to do so on time will result in the loss of the right to such claim. In no event shall Festival Travel be liable for other compensatory damages and hereby expressly waives any right to incidental, consequential and punitive damages. You agree that any legal or equity action or claim arising out of or relating directly or indirectly to the Services and these terms and conditions shall be governed by the laws of the State of California, without regard to any conflict of law’s provisions. You agree to bring any such action or claim only in the courts located in Orange County, California and hereby agrees to such place and consent and submits to the personal jurisdiction of such courts for the purpose of litigating any action or claim.
The transmission of facsimile, e-mail or via Telefonica of any signed document shall be considered the delivery of an original.
We reserve the right to refuse to do business with anyone in a non-discriminatory manner.
